Gemma Harte Photography

These Terms & Conditions apply to all bookings, sessions, and purchases made with Gemma Harte Photography.

Booking & Payment

A booking is only confirmed once the session fee or chosen collection has been paid in full, or a valid gift voucher has been redeemed.

Session fees secure your date and time and are non-refundable.

Remaining balances (if applicable) must be paid as agreed at least 3 days prior to the session

Failure to attend a booked session without notice will result in the session being forfeited.

Any chargebacks or payment disputes will be treated as a breach of these Terms & Conditions, and all relevant booking confirmations and agreements will be provided as evidence.

Rescheduling & Cancellations

Rescheduling is permitted with a minimum of 7 days’ notice.

Requests made within 7 days of the session may incur a new session fee.

In the case of illness, emergency, or bad weather, I will always do my best to reschedule your session at the earliest available opportunity.

All rescheduled sessions are subject to availability.

Clients are responsible for arriving on time, prepared for their session, and ensuring children are ready for the experience. Delays or lack of preparation may reduce shooting time.

The Photography Session

Each session is guided by my creative direction, including posing, lighting, styling, and final image selection.

While every effort is made to capture a full gallery, specific images cannot be guaranteed.

Sessions are relaxed and child-led where appropriate, particularly for newborn, baby, and family sessions.

I am not responsible for missed images due to late arrival, interruptions, or lack of cooperation during the session.

Props, styling, and setup choices are at the photographer’s discretion and may vary depending on the session, age of the child, and safety considerations.

Newborn & Child Safety

Safety is always the highest priority during newborn and child sessions.

Parents or guardians must remain present and responsible for children at all times.

I will never place a baby or child in an unsafe position or situation.

If at any point a setup is deemed unsafe or unsuitable, it will be adjusted or removed.

In the case of newborn illness, child illness, or any situation where the session is deemed unsafe or unsuitable, the session will be rescheduled.

Travel & Mobile Sessions

Travel within a 20-mile radius of B14 postcode is included unless otherwise stated.

Additional travel may incur a small fee of 60p per mile, agreed prior to booking.

A suitable space must be provided for in-home sessions.

Image Selection & Editing

All images are professionally edited in my signature style.

RAW or unedited images are never released under any circumstances.

Final image selection depends on the collection purchased unless a full gallery has been included.

Additional images may be purchased separately if desired.

Digital Images & Delivery

Final images are delivered via a private online Pixieset gallery.

Galleries remain available for a limited time; it is the client’s responsibility to download and back up images promptly.

Once downloaded, I am not responsible for loss or corruption of files.

Image Storage

Edited images are stored for a limited period only.

After this time, files may be permanently deleted without notice.

Re-delivery may not be possible once galleries expire.

Copyright & Usage

Gemma Harte Photography retains full copyright of all images at all times.

Clients are granted a personal use licence only.

Images may not be edited, cropped, filtered, or altered in any way by the client or any third party, including the application of filters, presets, or AI edits.

Images may not be used for commercial purposes without written permission.

Portfolio & Marketing Use

I may use selected images for portfolio, website, social media, and marketing unless otherwise agreed in writing.

If you prefer your images not to be shared, please notify me at the time of booking.

Prints & Products

Any prints or products ordered should be checked upon delivery.

Issues must be reported within 48 hours.

I cannot accept responsibility for damage after delivery or incorrect handling/storage.

Custom products are non-refundable once ordered.

Liability

Every care is taken to provide a safe and professional experience.

I am not liable for injury or damage unless caused by proven negligence.

Clients are responsible for their own belongings and personal safety during sessions.

Acceptance of Terms

By booking a session, paying a session fee, purchasing a voucher, or attending a photoshoot with Gemma Harte Photography, you confirm that you have read, understood, and agree to these Terms & Conditions.
